TERMS OF USE

INTRODUCTION


The following terms and conditions apply to your purchase at malmwatches.com. The terms of purchase are an agreement between you and MALM Watch Group AB, org. No. 559081-3829. When you make a purchase at malmwatches.com, you agree to the following terms of purchase. We therefore ask you to read them carefully.

CONFIRMATION


When we have received your order, we will send you a confirmation email to the email address you specifed in your purchase. Therefore it is very important that you give us the correct email address when placing your order. We recommend that you save your confirmattion email regarding your order for any future contact and support with MALM. The confirmation email also applies as proof that you have made a purchase at malmwatches.com.

PAYMENT


You can choose between different payment methods. Either you can choose to pay with your bank or credit card through the global Stripe payment service, or you can choose to pay with your PayPal account. Please note that your debit card will be charged directly upon purchase. MALM never handles or saves any bank or card information. MALM offers purchases in Euro (€). If your bank use another currency, your purchase will automatically be converted to your local currency by your bank the same day as your purchase.

RETURNS AND REPURCHASE


You are entitled to return your order within 30 days of purchase. This right only applies if the product and the packaging from your purchase are intact. If you want to return your order, please contact us to receive information on how to proceed. Returns made within 30 days of purchase will be returned free of charge.

WARRANTY


Each product from MALM include a 2 year warranty. The warranty covers defects and damage from the manufacturing process such as parts of boett, dial, glass, link / band, and movement. 


If you purchased your MALM product through one of our authorized retailers and have questions about warranty and complaints, please contact them directly and not MALM. If you purchased your MALM product via malmwatches.com, please contact us via the contact form at malmwatches.com or send an email to support@malmwatches.com and we will provide you with more information. In this message, you need to provide your name, address, order number and a detailed description of your warranty issue. Please use "Complaint of purchase" as title in your message. To use the warranty, it requires that you have access to a purchase receipt, an order confirmation or order number. 


If your warranty claim falls within the scope of our warranty terms, the defective product or part will be repaired or replaced within a reasonable time after MALM received the product. MALM strives to always replace defective parts with original parts, but reserves the right to replace defective parts with equivalent parts if the original is not available. 


If MALM does not find any of the errors and injuries mentioned above, the product will be sent back to you. 


Please note that this warranty is subject to the following exceptions and limitations: 

- The product is damaged due to inappropriate and negligent use (marks, bumps and damage to the product, broken / broken glass). 

- Damage caused by fire, water or natural disaster. 

- Natural aesthetic changes that occurred during normal use and aging (minor scratches, shade changes and dirt, or other marks in materials and bands). 

- Replacing the battery.Please note that MALM will charge a fee for repair and service for the warranty claims that fall within the scope of these exceptions and limitations.

PERSONAL INFORMATION, DATA AND HANDLING


When you make a purchase at malmwatches.com, we will save some of your personal information in order to complete your purchase and deliver your product. We need to save your name, address, email and/or phone number and so on. You are entitled to request access to this information and, if incorrect, you may change or request removal. MALM also use cookies in order to make shopping experience at malmwatches.com better. Please read our Privacy and Cookie Policy for detailed information about how we handle your personal data.

PRODUCT INFORMATION, PRICING AND IMAGES


MALM is entitled to change pricing or other product information without notice. The product images are intended to illustrate what the products look like in real life. Please note that we reserve ourselves for possible errors and bugs that may appear on malmwatches.com. We can therefore never guarantee that the products are reproduced in a 100% accurate way. Also note that because MALM uses real stone dials, this means that each dial has a unique look. Images should always be seen as illustrations.

DELIVERIES


MALM ship their products to customers from all over the world. Within Sweden, deliveries are usually made using Swedish PostNord or DHL, but we reserve the right to freely change courier according to what we think is the best choice at that particular moment. For international sending, PostNord, DHL and UPS and their international partners are usually used. We ship orders the same workday as the purchase or the workday after. Depending on destination, delivery time varies. The following estimate can be seen as a guideline for our delivery times:


- Sweden: 2-4 workdays

- Europe: 5-8 workdays

- North America: 7-14 workdays

- Rest of the world: 12-20 workdays

CANCELLATIONS


You are entitled to cancel your order and return it within 30 days after you received it. Please note that we ask you to contact us first in order to get information about how to do this the right way. Returns, repurchases and cancellations presuppose that the product / products are in the existing and identical condition as when you received them. Any damage that occurs when shipping back to MALM is your responsibility as a customer. Therefore, be careful how to pack your return. We recommend you to use the same packaging as used when you received your order. 

COMPLAINTS


It is important that you carefully examine your order when you receive it. If your product has been damaged during transport, you must inform MALM as soon as possible. This applies regardless of whether the damage is visible or not. All questions about complaints should be made to support@malmwatches.com. Please inform MALM of your order number and the reason for your complaint and we will return as soon as possible with infromation of how to proceed to return or replace your product. Damaged products that will be returned to MALM must be handled with care by the customer as if they were flawless. Regardless of the reason behind changing and repurchasing it is very important that the product is packed in such a way that it is not damaged in the shipping back to MALM. You are entitled to change to the same model, and if the model is sold out, you are entitled to receive the money back. If a dispute arises between you as a customer and MALM, and we fail to agree, you can leave your complaint to the EU's operational dispute resolution online, ODR (http://ec.europa.eu/odr).

FORCE MAJEURE


MALM shall be exempt from liability and consequences caused by circumstances beyond control. As such, government action, new / amended laws, war, fires, floods, work interruptions, prohibition, restrictions, tampering, poor transport and weather conditions, lack of supply from suppliers or MALM or its partners are subject to criminal activity.

USER-GENERATED CONTENT


Malmwatches.com may contain user-generated content from, for example, social media. MALM accepts no legal responsibility for such material. If you suspect copyright infringement, or breach of any other right, or if any other reason for the content posted on malmwatches.com, please contact our customer service at support@malmwatches.com.

OWNERSHIP


All products remain MALM's property until full payment is paid.

FRAUD


All frauds or attemt fraud will be reported to the Swedish police. MALM is entitled to cancel a purchase if there is suspicion of a crime.

GOVERNING LAW AND JURISDICTION


Swedish law applies to these terms and conditions and your use of malmwatches.com. To the extent permitted by law, Swedish courts have exclusive jurisdiction over disputes arising out of these terms or your use of the site, except for cases where MALM voluntarily chooses to take legal action against a customer / user where he or she has his or hers home.

TERMINATION


MALM reserves the right to remove your account and / or use of malmwatches.com at its sole discretion, for example, if MALM suspects you violated these terms. Such actions can be taken without informing you about it.

VALIDITY


Should one or more of these terms be declared invalid or judged by a court or regulatory authority, this shall not affect the validity of the remaining terms.

CHANGES AND DEVELOPMENT OVER TIME


MALM can change and develop these terms and conditions over time. Each time you purchase a product from malmwatches.com, the terms and conditions applicable will be applicable to the contract between you and MALM. Therefore, we recommend that you regularly visit this page to update you about the content and any changes.
